We Fought The Law And...

As of this writing, it has been eight days since we sent our response to Wynn Las Vegas regarding their cease & desist request that attempted to bully us into handing over the Wynncore.com domain name and the artwork contained therein.

Our response to their missive, which we have confirmed that they have received, contained standard boiler plate language at the end:

Failure to respond to me within five (5) days will be interpreted as Wynn Resorts amicably withdrawing its initial Bad Faith Domain Registration of "wynncore.com" and Infringement Of The Wynn Name and Wynn Trademark request.

Any lawyer will tell you that the inclusion of "failure to respond" time frame is wholly unenforceable language meant to threaten the uninformed. That being said, Wynn Resorts has yet to officially contact us about the affair, nor send us requested amendments to a potential agreement nor send us payment in the format requested in exchange for the Wynncore.com domain name. In essence, they are three days past checking out of their suite and we are now entering the room.

By cause of surrender, I hereby claim victory over Wynn Resorts in the Battle of Wynncore.

Unofficially, we heard that our response letter sent cascades of howling laughter throughout the Wynn Resorts offices the day we posted it.

We would like to thank all of our friends and loyal readers, particularly those who posted comments to both of the Wynncore related blog posts and shared opinions on The Twitter, members of the Legal Defense Clinic at the University of San Francisco, the Electronic Frontier Foundation, fellow bloggers and podcasters who helped spread the word about our plight, Jon Humbert at KLAS-TV in Las Vegas who interviewed me about it even though the interview never aired, and last but not least my lovely wife Miss Monkay who courageously placed all of her trust in me when we decided to fight for our rights to free speech and artistic expression against a gigantic corporation that prints money for a living.

Let's just hope that this does mean that this matter is dead and buried.

Looks like I will be sticking to my plans in 15 days to have lunch @ Society Cafe. Of course if the Wynncore situation changes before then into something negative, then I may forgo those plans.

I could only think of this.

Indeed I also have reservations for a Wynncore property in a couple of weeks and I will be keeping an eye out for any near-term developments to see if I will be keeping those arrangements.

Excellent! Wynn resorts needs to learn how to take a joke. @vespajet if you do skip Society, hop across the street to Stripburger for a pint of PBR errr Sierra Nevada and an awesome Turkey Burger and fried pickles.

any plans for wynncore.com now that Wynn Resorts withdrawed their request? A new joke perhaps? hahaha

True to my word, during my 5 day trip to Las Vegas, which ended Monday, I did not spend one cent in any Wynn Resorts property, nor did I even go within two blocks of the place. There are plenty of other places in Las Vegas for me to spend my money and Wynn now joins my lifelong boycott of the Flamingo, as places that have either done me wrong or a friend wrong and hence lost my business forever.
